Amateur radio operation during a short stay in Poland

Foreign nationals and Polish citizens permanently residing abroad may operate an amateur radio station in Poland without obtaining a Polish amateur radio authorization during a single stay not exceeding 90 days, provided that such operation is permitted under the applicable international regulations.

In particular, this applies to holders of a valid CEPT Radio Amateur Licence issued in accordance with CEPT Recommendation T/R 61-01 by an administration participating in that arrangement.

A foreign amateur radio licence which is not covered by CEPT Recommendation T/R 61-01 or another applicable international arrangement does not, by itself, authorize its holder to operate an amateur radio station in Poland.

When operating in Poland under CEPT Recommendation T/R 61-01, the operator must:

• use the Polish prefix SP, followed by “/” and the operator’s home call sign, for example SP/DL1ABC;
• comply with the provisions in force in Poland, including Polish frequency allocations, technical conditions and any band-specific power restrictions;
• carry the original valid amateur radio licence or another document confirming that the licence constitutes a CEPT Radio Amateur Licence under Recommendation T/R 61-01;
• present the relevant documents to the competent authorities upon request.

The operating privileges are those corresponding to a Polish Category 1 amateur radio authorization. The maximum transmitter output power is generally 500 W, unless a lower limit or other restrictions apply to a particular frequency band.

Holders of licences issued by non-CEPT administrations may operate under T/R 61-01 only where that administration participates in the CEPT arrangement and all additional conditions imposed by the issuing administration are fulfilled. For example, CEPT privileges based on a U.S. FCC licence are available only to U.S. citizens who meet the conditions set out in FCC Public Notice DA 16-1048.

How to apply

Applications may be submitted:

• electronically via the e-Delivery system (e-Doręczenia) — available to persons who have a PESEL number and an active e-Delivery address;
• by post to: Urząd Komunikacji Elektronicznej, ul. Giełdowa 7/9, 01-211 Warszawa, Poland;
• in person at the UKE office.

Required documents

The documents required depend on the category of amateur radio authorization applied for.

Category 1 authorization

The application should be accompanied by one of the following:

• a document confirming a positive result of an amateur radio examination corresponding to the requirements for a Category 1 authorization; in the case of a document issued by a competent foreign authority, this will normally be a Harmonised Amateur Radio Examination Certificate (HAREC) compliant with CEPT Recommendation T/R 61-02 or another document confirming equivalent examination qualifications; or
• a valid Class A or Class B amateur radio operator certificate issued by the President of UKE, or an equivalent certificate issued by a competent Polish or foreign authority; or
• a valid amateur radio authorization issued by a competent foreign authority, granting operating privileges at least equivalent to those of a Polish Category 1 amateur radio authorization. A CEPT Radio Amateur Licence issued in accordance with CEPT Recommendation T/R 61-01 is the standard document used for this purpose.

Category 3 authorization

The application should be accompanied by one of the following:

• a document confirming a positive result of an amateur radio examination corresponding to the requirements for a Category 3 authorization; in the case of a document issued by a competent foreign authority, the scope of the examination should correspond to the syllabus described in ERC Report 32; or
• a valid Class C or Class D amateur radio operator certificate issued by the President of UKE, or an equivalent certificate issued by a competent Polish or foreign authority.

A Category 3 authorization is not issued solely on the basis of a foreign amateur radio licence. The applicant must submit a document confirming the relevant examination qualifications or an equivalent operator certificate.

Additional documents

The application should also be accompanied by:

• a Polish translation of every document drawn up in a foreign language; where necessary to verify the contents or authenticity of the document, UKE may require a translation prepared or certified by a sworn translator;
• proof of payment of the stamp duty.

UKE assesses whether the submitted foreign document is equivalent to the relevant Polish document and whether it confirms the required examination qualifications or operating privileges. Submission of a foreign licence or certificate does not automatically guarantee that a Polish amateur radio authorization will be issued.

Period of validity

The period of validity of the authorization depends on the documents held by the applicant:

• holders of a valid amateur radio licence issued in accordance with CEPT Recommendation T/R 61-01 may obtain an authorization valid for a period not exceeding the validity period of their home-country licence;
• holders of a CEPT Harmonised Amateur Radio Examination Certificate (HAREC) may obtain an authorization valid for up to 25 years.

Fees

The issuance of an amateur radio authorization is subject to a stamp duty of PLN 82.
